Delhi MenCell: Settlement Sign करने के बाद Wife ने Divorce से पीछे हट गई तो Husband क्या करे?
“Settlement हो गया था… पैसे भी दे दिए… First Motion भी हो गया… फिर भी Divorce क्यों नहीं हुआ?”
यह situation ordinary matrimonial dispute से काफी अलग हो सकती है।
13 April 2026 को Supreme Court ने Dhananjay Rathi v. Ruchika Rathi, Criminal Appeal No. 1924/2026, 2026 INSC 360 में इसी तरह के complicated matrimonial settlement को deal किया।
Husband ने Saket Family Court, Delhi में divorce proceedings शुरू की थीं। बाद में Delhi Mediation Centre, Saket के सामने settlement हुआ।
Settlement में wife को ₹1.50 crore full-and-final settlement amount, jewellery और car purchase के लिए ₹14 lakh जैसी terms थीं। First Motion के समय husband ने ₹75 lakh + ₹14 lakh और agreed jewellery hand over की। Wife ने भी settlement के तहत substantial transfer किया।
फिर कहानी बदल गई।
Wife ने Second Motion के लिए consent continue नहीं किया और बाद में Section 12 DV Act proceedings भी शुरू हुईं।
Delhi High Court ने interim stage पर wife द्वारा received ₹89 lakh deposit कराने और jewellery को preserve करने की directions दी थीं, जबकि DV proceedings को उस stage पर completely रोकने से Court ने परहेज किया।
Matter Supreme Court पहुँचा।
Supreme Court ने parties की prolonged separation, settlement, subsequent disputes और marriage के irretrievable breakdown को देखते हुए Article 142 की extraordinary power exercise की और marriage dissolve कर दी।
लेकिन यह कोई simple “settlement sign = automatic divorce” rule नहीं है।
Supreme Court ने divorce को specific financial and property obligations की compliance से connect किया। Husband को remaining ₹70,22,871 pay करने और specified PPF passbook hand over करने का direction दिया गया; failure की स्थिति में divorce effective नहीं होना था. Settlement-linked proceedings को भी Court ने consequentially deal किया।
यह point Delhi matrimonial case, Delhi husband, MenCell, Men Cell Delhi और Purush Aayog Delhi से guidance तलाशने वाले men के लिए बहुत important है:
Mediation settlement को “बस एक paper” समझकर sign करना risky हो सकता है।
Payment schedule, property transfer, jewellery, withdrawal of cases, future proceedings, First Motion, Second Motion और default consequences — हर clause का practical effect समझना जरूरी है।
कभी-कभी आदमी सोचता है:
“बस settlement हो गया, अब मामला खत्म।”
लेकिन अगर Second Motion बाकी है, consent वापस लिया जा सकता है, कोई obligation disputed है या settlement की compliance अधूरी है, तो matrimonial litigation फिर complicated हो सकती है।
इसलिए Delhi/NCR husband के लिए mediation में सिर्फ settlement amount negotiate करना ही पूरी strategy नहीं है।
Settlement का wording, sequence of performance और default mechanism भी उतना ही important है।

Case-specific caution: यह Supreme Court decision अपने extraordinary facts, concluded mediation settlement, payments, property-related obligations, subsequent DV proceedings and prolonged matrimonial breakdown पर आधारित था। इससे यह general rule नहीं बनता कि हर mediated settlement के बाद एक spouse के पीछे हटने पर Supreme Court automatically divorce grant करेगा या सभी matrimonial proceedings समाप्त हो जाएँगी।
Delhi matrimonial dispute में settlement final करने से पहले अपनी obligations और दूसरे पक्ष की obligations को लिखित रूप में समझना — बाद की litigation से बचने की दिशा में एक महत्वपूर्ण precaution हो सकता है।
